Quick answer Airbnb and VRBO income from a Las Vegas short-term rental is taxable, and most hosts report it on Schedule E, or on Schedule C if they provide hotel-like services such as daily cleaning or meals. Our fees depend on the forms your return needs. Call 702-871-7884 for a quote.

Key facts (updated October 29, 2026)

Local rules first: the license comes before the tax return

Clark County adopted its short-term rental ordinance on June 21, 2022, after the Nevada Legislature passed Assembly Bill 363 in 2021. In unincorporated Clark County you may only operate or advertise a short-term rental with a county short-term rental license, and the license number must appear in your listing. The county stopped taking applications after August 21, 2023, and says operating without a license can lead to enforcement. On October 20, 2026 the county introduced proposed amendments to its short-term rental code; they are proposed, not adopted, so check the county page before you buy or list a property.

The City of Las Vegas, Henderson and North Las Vegas each set their own short-term rental rules, and Henderson also uses a 1,000-foot separation. Check with the city that issues your business license. We prepare your taxes; we don't give licensing or legal advice, but we can tell you what your license and room-tax records mean for your return.

Schedule E or Schedule C?

The 7-day rule (the "short-term rental loophole")

If the average guest stay is 7 days or less, the property is generally not treated as a rental activity under the passive activity rules. If you also materially participate, for example more than 100 hours in the year and not less than anyone else, including your cleaner and co-host, the losses may be non-passive and can offset W-2 or business income. If you can't meet that, the losses stay passive. The IRS reviews these claims, so keep a time log as you go.

Depreciation: often 39 years, not 27.5

A long-term rental home is usually depreciated over 27.5 years. When most stays are transient (30 days or less), the building is often treated as nonresidential real property and depreciated over 39 years instead (IRS Pub 946). That's one reason furnished short-term rentals are a common fit for a cost segregation study: furniture, appliances and many interior items fall into 5-, 7- or 15-year classes. Property acquired after January 19, 2025 may qualify for 100% bonus depreciation on those shorter-life items. If you bought in an earlier year and never claimed it, Form 3115 can catch up the missed depreciation.

Deductions hosts should track

Personal use and the 14-day rule

Room tax and your return

Airbnb and VRBO collect and remit some local lodging taxes for hosts, but not always every tax in every area. Room tax you collect from guests and pay over yourself is generally included in income and then deducted as an expense. Bring your platform earnings reports and your remittance records, and we match them.

A material participation time log

Write down the date, task and time for guest messages, turnovers you do yourself, restocking, repairs, listing updates and bookkeeping. Also note hours by your cleaner or co-host, because their hours count against the "not less than anyone else" test. A log kept during the year is far stronger than one rebuilt at tax time.

Frequently asked questions

How much does iQTAXX charge for an Airbnb tax return?

Our fees depend on the forms your return needs. Call 702-871-7884 for a quote.

Do Airbnb hosts in Las Vegas need a license?

Yes. Unincorporated Clark County requires a short-term rental license for stays of 30 days or less, and its application period closed August 21, 2023. The cities set their own rules, so check with the city that licenses your property.

What is the short-term rental loophole?

If the average guest stay is 7 days or less and you materially participate, the rental is generally not a passive rental activity, so losses may offset other income. You must be able to prove your hours.

Is Airbnb income reported on Schedule E or Schedule C?

Usually Schedule E. If you provide substantial services such as daily cleaning or meals, Schedule C may apply and self-employment tax can be due.

Is a short-term rental depreciated over 27.5 or 39 years?

When most stays are 30 days or less, the building is often depreciated over 39 years as nonresidential property, not 27.5 years. Furniture and many interior items have shorter lives.

Can I use cost segregation on a short-term rental?

Yes. Furnished short-term rentals are a common fit, and property acquired after January 19, 2025 may qualify for 100% bonus depreciation on shorter-life items. iQTAXX does cost segregation in house.

What if I stay in my rental part of the year?

Personal use over the greater of 14 days or 10% of the days rented at a fair price limits your deductions to your rental income.

Will I get a 1099-K from Airbnb?

Platforms generally send a 1099-K above $20,000 and 200 transactions. All rental income is taxable even without one.
